These Terms of Service (“Terms”, “Agreement”) constitute a legally binding agreement between you (“User”, “Customer”, “Buyer”, or “Vendor”) and the platform administration of KateDeal (“KateDeal”, “Platform Administration”, “we”, “us”, or “our”), governing your access to and use of our website, e-commerce infrastructure, customer portals, and related fulfillment services.

By browsing, creating an account, or placing an order on KateDeal, you confirm that you have read, understood, and agreed to be bound by these Terms, as well as our Privacy Policy and Returns & Refunds Policy. If you do not agree, you must discontinue using the platform immediately.

1. Marketplace Platform Architecture & Operating Model

KateDeal operates as an independent international e-commerce marketplace and managed fulfillment network under Ukrainian private entrepreneurial registration (FOP), with its principal operational facilities headquartered at the KateDeal Logistics & Operational Hub, Uzhhorod, Zakarpattia Oblast, Ukraine.

Curated Multi-Category Network: KateDeal curates, indexes, and presents technical components (energy storage, battery cells, BMS electronics), workshop tooling, 3D printing media, and handcrafted interior decor sourced directly from verified workshops, fabricators, and certified manufacturers.
Fulfillment & Quality Intermediary: For international orders, KateDeal operates quality control intake, centralized consolidation, export packaging, and logistics dispatch through our Uzhhorod fulfillment facility to safeguard transaction integrity.

2. Account Registration, Security & User Conduct

Eligibility: You must be at least 18 years of age or possess the legal capacity to enter into binding contracts under the laws of your jurisdiction to purchase goods or register an account.
Account Integrity: You agree to provide accurate, current, and complete information during registration and checkout. You are solely responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account.
Prohibited Activities: Users are strictly prohibited from:
- Attempting to compromise the security, integrity, or network availability of katedeal.com.
- Engaging in fraudulent payment transactions or chargeback abuse.
- Using automated scrapers, data-mining tools, or bots without explicit written consent from Platform Administration.
- Misrepresenting product quality or posting false, defamatory reviews.

3. Orders, Pricing & Payment Processing

Order Acceptance: All orders submitted via the website are subject to acceptance by KateDeal. We reserve the right to refuse or cancel orders due to unauthorized pricing errors, stock discrepancies, suspicion of fraud, or export control restrictions.
Pricing & Taxes: Product prices are displayed in supported currencies (USD, EUR, UAH). Prices do not include destination customs duties, local import taxes, or regional delivery surcharges unless explicitly stated at checkout.
Payment Gateways: Transactions are processed via licensed international third-party payment gateways utilizing 256-bit SSL encryption. We do not store full payment card credentials on platform servers.

4. Product Safety, Installation & User Responsibility

Because KateDeal hosts diverse catalog categories—including electrical devices, power systems, precision workshop tools, chemical adhesives, and mechanical components—safe handling and proper operation are paramount:

Competence & Compliance: Buyers purchasing technical equipment, electrical hardware, tools, or chemical compounds acknowledge that they possess the requisite competence, safety gear, and qualified environments to install, handle, and operate such goods in compliance with applicable local building, electrical, and environmental regulations.
Adherence to Manufacturer Specifications: All items must be used strictly in accordance with published manufacturer datasheets, operating manuals, environmental tolerances, and rated load parameters.
Limitation of Liability for Improper Integration: To the maximum extent permitted under applicable law, KateDeal and its marketplace sellers disclaim all liability for personal injury, property damage, secondary equipment breakdown, or collateral financial losses arising from improper assembly, uncertified installation, electrical overload, unauthorized alterations, or failure to follow safe handling standards.

5. Intellectual Property Rights

All website content, including brand logos, visual graphics, product descriptions, photography, technical buying guides, code, and interface layouts, is the exclusive property of KateDeal or its content licensors, protected by international copyright, trademark, and intellectual property conventions. Unauthorized reproduction, commercial distribution, or mirror hosting is strictly prohibited.

6. Disclaimers & Limitation of Liability

“As-Is” Platform Provision: The marketplace platform and all services are provided on an “as-is” and “as-available” basis without warranties of uninterrupted uptime or error-free operation.
Maximum Monetary Cap: In no event shall KateDeal, its operators, employees, or verified suppliers be liable for indirect, incidental, punitive, or consequential damages. In all instances, the maximum aggregate liability of KateDeal arising out of any order shall be limited strictly to the total purchase amount actually paid by the buyer for the specific item in dispute.

7. Force Majeure

Neither party shall be held liable for delivery delays or failure of performance resulting from events beyond reasonable operational control, including acts of God, armed conflict, severe logistics blockades, border closures, national power grid disruptions, extreme weather catastrophes, or regional labor strikes.

8. Governing Law & Dispute Resolution

These Terms and any contractual disputes shall be governed by and construed in accordance with the applicable commercial laws of Ukraine, giving effect to international trade practices. In the event of a dispute, parties agree to first seek an amicable, good-faith resolution by contacting our compliance desk at [email protected]. If an unresolved controversy persists after 30 calendar days, it shall be submitted to the competent commercial courts having territorial jurisdiction over the KateDeal Operational Hub in Uzhhorod, Ukraine.

9. Amendments to Terms

Platform Administration reserves the right to modify these Terms at any time to reflect legislative updates, platform upgrades, or changes in logistical procedures. Continued use of katedeal.com following posted amendments indicates full acceptance of the revised Terms.
